Constitutional Court Sets December 3 Hearing in Arshad Sharif Murder Case

The Federal Constitutional Court has fixed December 3 as the hearing date for the high-profile case concerning the murder of Pakistani journalist Arshad Sharif. A two-member bench comprising Justice Aamir Farooq and Justice Rozi Khan will preside over the proceedings.

The case was originally taken up by the Supreme Court after it initiated suo motu notice on the killing. However, following the passage of the 27th Constitutional Amendment, all suo motu matters have since been transferred to the newly established Federal Constitutional Court, now responsible for hearing such cases.

Background of the Case

Arshad Sharif, a prominent journalist, was shot dead on October 23, 2022, by Kenyan police along the Magadi Highway in Nairobi. Initially, Kenyan authorities termed the killing a case of “mistaken identity.” But subsequent findings revealed notable contradictions in the police narrative, raising questions about the circumstances of the incident and prompting calls for a transparent investigation.

The journalist’s death triggered widespread shock and condemnation in Pakistan and abroad, with rights organisations, journalists’ bodies, and Sharif’s family demanding accountability and clarity regarding the events leading to the fatal shooting.

Next Steps

With the case now before the Federal Constitutional Court, the upcoming hearing is expected to determine the future trajectory of the legal proceedings, including updates on investigations, responsibility of Kenyan authorities, and Pakistan’s efforts to seek justice in the cross-border case.

The hearing on December 3 will mark a significant step in the long-standing pursuit of answers surrounding Sharif’s killing.
