Supreme Court judge Justice Musarat Hilali has resigned from being appointed as a judge of the newly formed Federal Constitutional Court (FCC), citing health concerns, sources confirmed on Friday.
Justice Hilali’s name was under consideration for the FCC following the passage of the 27th Constitutional Amendment, which established the court. However, due to ongoing health issues, she expressed her unwillingness to take on the post. Her bench had been delisted in recent days due to her ill health.
The appointment of Justice Aminuddin Khan as the first Chief Justice of the Federal Constitutional Court was approved by President Asif Ali Zardari on the recommendation of Prime Minister Shehbaz Sharif, following approval from both the Senate and the National Assembly.
Separately, two senior Supreme Court judges, Justice Mansoor Ali Shah and Justice Athar Minallah, resigned from their positions over concerns regarding the 27th Amendment, submitting their resignations to the President. Their resignations have raised significant debate over judicial independence and the implications of the constitutional changes.
Justice Musarat Hilali’s decision adds another development to the ongoing judicial and political discourse surrounding the formation and functioning of the Federal Constitutional Court in Pakistan.
