The Islamabad High Court (IHC) on Tuesday directed its registrar’s office to fix for hearing on March 10 a plea filed by Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan seeking permission to undergo medical treatment at Shifa International Hospital.

The court also scheduled the hearing of the main appeal in the Toshakhana criminal case — the matter in which the former prime minister was first arrested on August 5, 2023 — for the same date.

A division bench comprising Justice Arbab Muhammad Tahir and Justice Khadim Hussain Soomro heard the case, along with objections raised by the Registrar’s Office regarding the miscellaneous application. Senior counsel Latif Khosa, assisted by Salman Akram Raja and other members of the legal team, appeared before the court.

During the proceedings, the bench questioned the nature of objections raised by the registrar. Khosa informed the court that one objection concerned the absence of a certified copy of the power of attorney. Justice Tahir observed that two of the objections appeared valid. Subsequently, the court directed the office to number the application once the objections were removed.

The bench also asked the defence why arguments were not being advanced in the main appeal. Khosa responded that the legal team was ready to proceed and requested that the matter be taken up the following day. However, the bench decided to hear both the main appeal and the medical plea together on March 10, directing counsel to come fully prepared.

The court further inquired whether the paper book in the appeal was ready and instructed the registrar’s office to prepare it within two to three days.

Notably, the bench observed that the sentence in the Toshakhana case had already been suspended. It also issued notice to the state on the plea seeking Khan’s transfer to Shifa International Hospital for medical treatment.

Legal and Medical Challenges

Imran Khan has remained incarcerated since August 5, 2023. He is currently serving a 14-year sentence in the £190 million corruption case at Rawalpindi’s Adiala Jail.

Although the IHC suspended his three-year sentence in the Toshakhana case in August 2023, his detention continued due to other cases, including the cipher case — in which he was later acquitted.

In December 2025, he was convicted in another Toshakhana case involving the purchase of a Bulgari jewellery set gifted by the Saudi crown prince during an official visit in May 2021. An Islamabad special court sentenced Khan and his spouse, Bushra Bibi, to a combined 17-year term in that case.

Additionally, Khan faces pending trials under the Anti-Terrorism Act in connection with the May 9, 2023 riots.

The IHC is also scheduled to hear petitions filed by Khan and Bushra Bibi seeking suspension of their sentences in the £190 million case on March 11.

Meanwhile, concerns about Khan’s health have intensified after it was revealed in January that he was diagnosed with right central retinal vein occlusion (CRVO), leading to partial vision loss in his right eye. Following the intervention of the Supreme Court, doctors confirmed that with corrective glasses, he currently retains 6/9 partial vision in the affected eye.

His family and personal physicians have requested his admission to Shifa International Hospital for comprehensive medical care. However, the Supreme Court recently raised objections to a plea seeking his transfer to a hospital of his choice.

All eyes are now on the March 10 hearing, where the high court is expected to take up both the medical plea and the Toshakhana appeal simultaneously.
