Mustafa Nawaz Khokhar Moves SC Against 26th Constitutional Amendment

Mustafa Nawaz Khokhar, leader of the Pakistan Constitution Protection Movement, has filed a petition in the Supreme Court challenging the 26th Constitutional Amendment and seeking enforcement of the full court decision under the Practice and Procedure Act.

The petition maintains that the decision to constitute a full court under Section 2.2 of the Act is legally valid and cannot be overturned by the Registrar or any other authority. It argues that the Chief Justice’s explanation for not implementing the committee’s decision has no constitutional or legal standing.

According to the plea, the amendments made through the 26th Constitutional Amendment are not consistent with the Constitution and law. It further requests the apex court to declare the administrative order regarding non-implementation of the committee’s decision as null and void.

The petition underscores that on October 31, the Supreme Court’s Practice and Procedure Committee had resolved to form a full court to hear the matter of the 26th Amendment. Khokhar has urged the court to ensure that this majority decision is respected and enforced.

The move reflects growing debate within legal and political circles over constitutional amendments and the implementation of internal judicial procedures, particularly regarding the authority of committees versus administrative decisions within the judiciary.
