Five judges of the Islamabad High Court (IHC) have formally raised concerns over the recently issued seniority list of judges.
According to sources, a representation against the seniority list has been submitted to Chief Justice of the Islamabad High Court, Aamir Farooq. A copy of the representation has also been forwarded to Chief Justice of Pakistan, Justice Yahya Afridi.
Judges Involved
The judges challenging the seniority list include:
- Justice Mohsin Akhtar Kiani
- Justice Tariq Mahmood Jahangiri
- Justice Babar Sattar
- Justice Sardar Ijaz Ishaq Khan
- Justice Saman Riffat Imtiaz
Sources indicate that separate representations are also expected from Justice Mian Gul Hassan Aurangzeb and Justice Arbab Muhammad Tahir.
Core Issue
The representation reportedly argues that judicial seniority should be determined based on the oath taken at the High Court of appointment. When a judge is transferred to another High Court, they must take a new oath, and their seniority should be recalculated accordingly.
Request to Postpone Judicial Commission Meeting
The judges have requested Chief Justice Afridi to postpone the upcoming Judicial Commission meeting until the seniority issue is resolved.
Judicial Sources Clarify
Sources within the judiciary have emphasized that the representation strictly pertains to seniority matters and is unrelated to judge transfers.
Background
The seniority list was issued the previous day with the approval of Chief Justice Aamir Farooq, sparking concerns among several judges.
The matter now awaits further action from Chief Justice Yahya Afridi and the Judicial Commission.
