Justice Najafi Highlights Role and Progress of Pakistan’s Constitutional Court

Justice Ali Baqir Najafi of the Federal Constitutional Court stated that the emergence of Pakistan’s Constitutional Court is not unprecedented, noting that a Constitutional Bench existed prior to its establishment. He made these remarks while addressing the Asma Jahangir Conference in Lahore.

Justice Najafi explained that he had previously worked on the Constitutional Bench and served in the Supreme Court for seven months in criminal matters. He rejected claims that the independence of the judiciary had been compromised.

According to Justice Najafi, challenging state authority falls outside the judiciary’s jurisdiction. He expressed concern over the long delays in murder appeals in the Supreme Court, attributing the backlog to judges being frequently engaged with constitutional matters. He added that the new Constitutional Court would largely resolve this problem.

He outlined several reasons for establishing the Constitutional Court, including judicial activism. Allegations had surfaced that the Supreme Court had overstepped its authority in several decisions, prompting the need for a dedicated constitutional forum.

Justice Najafi noted that the Constitutional Court was formally established on November 14, 2025. Since its inception, it has decided 2,600 cases. He emphasized that efforts are ongoing to ensure speedy resolution of cases filed in the Court.

The Constitutional Court’s creation is expected to streamline judicial processes, reduce case backlogs, and provide a focused platform for constitutional matters, while allowing other courts to handle criminal and civil cases more efficiently.
