Latif Khosa Files Petition for Early Hearing in Civilian Trial in Military Courts Case

Prominent lawyer Latif Khosa has filed a petition in the Supreme Court, requesting an early hearing in the case concerning the trial of civilians in military courts. The petition urges the court to fix the case for hearing in the last week of November.

In his application, Khosa argued that the Supreme Court had previously ordered the transfer of cases involving 103 accused civilians to other courts and had halted the final decision on inter-court appeals. The petition also noted that despite the court's directive on December 13, 2023, for the case to be heard in the third week of January 2024, the hearing had not yet been scheduled.

Khosa emphasized that the delay in scheduling the hearing was in violation of the Supreme Court's order and urged for an expedited process. He reminded the court of its July 11, 2024 ruling, which had deferred the hearing indefinitely but instructed that accused individuals not be treated inhumanely during their trials in military courts.

The case has drawn significant attention due to its implications for the rights of civilians and the jurisdiction of military courts in Pakistan. A seven-member larger bench, headed by Justice Aminuddin Khan, had previously heard appeals related to civilian trials in military courts.
