Nepra Rejects Industrial Consumer's Review Application Due to Non-Payment of Fee

The National Electric Power Regulatory Authority (Nepra) has dismissed the review application of an industrial consumer from Karachi who sought to challenge a decision regarding K-Electric’s generation tariff. The application was rejected because the consumer failed to pay the required review fee, despite submitting a general consumer fee of only Rs. 1,000.

The review application was filed on November 24, 2024, after Nepra’s decision on K-Electric’s generation tariff on October 22, 2024. Nepra’s ruling clearly stated that the applicant was not a party to the matter, and the application lacked the necessary fee of Rs. 934,722, which is required for the review of such decisions.

On a majority basis, Nepra decided to reject the review application due to the fee discrepancy. However, Nepra Member Tariff Motahir Niaz Rana dissented from the majority opinion, arguing that consumers should not be excluded from exercising their right to challenge regulatory decisions due to technical reasons like an unpaid fee.

In his dissenting note, Rana emphasized the importance of transparency and accountability, noting that consumer applications should be assessed on merit rather than procedural errors. He also highlighted that such applications had been heard in the past and argued that the Nepra Act should provide easier access for consumers to challenge decisions, proposing that the fee for such applications should be minimal or waived altogether.
