The federal government has moved an intra-court appeal (ICA) in the Lahore High Court (LHC) challenging a ruling by a single bench that declared the appointment of Lt Gen Muhammad Munir Afsar as chairman of the National Database and Registration Authority (NADRA) unlawful.

 

The appeal, submitted through the attorney general's office, contests the single bench’s order, arguing that it ignored key legal facts. The government insists it acted within its powers as outlined in Section 44 of the NADRA Ordinance, 2000, which allows the federal government to make rules, including amendments to them.

 

The appeal further maintains that the appointment of the NADRA chairman was carried out in accordance with Rule-7A of the NADRA (Appointment and Emoluments of Chairman and Members) Rules, 2020. According to the government, these rules allow discretionary appointments without the need for public advertisements or a competitive recruitment process.

 

The intra-court appeal calls for the division bench to set aside the single bench’s ruling and reinstate Lt Gen Muhammad Munir Afsar to his position as NADRA chairman.

 

The appeal will be heard by a two-member bench consisting of Justice Chaudhry Muhammad Iqbal and Justice Ahmad Nadeem Arshad on Tuesday (today). The original decision to invalidate Afsar’s appointment was made by Justice Asim Hafeez, following a petition from Ashba Kamran. Kamran had challenged the appointment, which was initially made by the caretaker government in October 2023 and later confirmed by the elected government in March 2024.
