Peshawar High Court Dismisses JUI-F Petition Challenging KP Chief Minister’s Election

The Peshawar High Court (PHC) on Wednesday dismissed a petition filed by Jamiat Ulema-e-Islam-Fazl (JUI-F) challenging the election of the Chief Minister of Khyber Pakhtunkhwa (KP), bringing a legal end to the party’s objections against the process.

During the hearing earlier in the day, the court presented two options to the petitioners — either withdraw the petition or allow the court to decide on its merits. JUI-F’s counsel opted for a decision on merits, after which the PHC reserved its judgment. Later, the court announced its decision, dismissing the petition.

The case stemmed from JUI-F’s challenge to the election process that brought PTI-backed Sohail Afridi to the office of Chief Minister. During proceedings, PTI’s counsel Salman Akram Raja argued that the province could not function without a chief minister and emphasized that the orders of the Chief Justice must be implemented unless declared invalid.

A day earlier, the Chief Justice of the Peshawar High Court had directed KP Governor Faisal Karim Kundi to administer the oath to the newly elected Chief Minister Sohail Afridi. The court also ruled that if the governor failed to do so, the KP Assembly Speaker would be authorized to administer the oath instead.

Following the court’s order, Governor Kundi confirmed that he would administer the oath to the Chief Minister at 4 p.m. today.

The dismissal of the JUI-F petition effectively validates the recent election of Sohail Afridi, paving the way for the formal assumption of his duties as Chief Minister. The verdict is seen as a significant setback for the JUI-F, which had sought to challenge the legality of the election amid political tensions in the province.
