SC Dismisses PTI Chief's Objections to Official Secrets & Army Act Amendments

The Supreme Court's constitutional bench, headed by Justice Aminuddin, has dismissed the objections raised by PTI founder Imran Khan regarding amendments to the Official Secrets Act and the Army Act.

The five-member bench directed the Registrar's Office to formally number the constitutional petition, effectively paving the way for legal proceedings to continue.

Legal Path Questioned

During the hearing, the bench questioned why the petitioner had bypassed the High Court. Justice Muhammad Ali Mazhar emphasized the procedural importance of approaching the High Court first.

“Petitions under Article 184(3) should be heard at will, but if the case is not entertained directly, petitioners must go to the High Court to avoid rendering Article 199 ineffective,” remarked Justice Mazhar.

Petitioner's Argument

Imran Khan’s lawyer argued that the amendments affected public rights, justifying a direct approach to the apex court. However, the bench maintained its stance on procedural protocol.

Court’s Decision

The court ruled that Imran Khan's objections were invalid and adjourned the hearing indefinitely, indicating that further proceedings would follow once the formal requirements were fulfilled.

This development adds a significant layer to the ongoing debate surrounding legal amendments impacting state security and judicial processes in Pakistan.
