The Federal Constitutional Court (FCC) heard petitions challenging the imposition of the super tax on taxpayer companies, with the government’s approach coming under sharp criticism during the proceedings.
The case was heard by a three-member bench headed by Chief Justice Aminuddin Khan. During the hearing, Makhdoom Ali Khan, representing several taxpayer companies, argued that Section 4C of the Income Tax Ordinance does not provide the legal basis to classify the tax, pointing out that the language in the section is unclear and insufficient.
He noted that the government had issued only a notification to continue tax collection, while Sections 4C and 4B had altered the definition of income, preventing companies from including expenses and losses when calculating taxable income.
Makhdoom Ali Khan also cautioned that if the government maintains its current stance on tax collection, it could face electoral consequences in the next elections.
The FCC adjourned the hearing for one day, with further proceedings expected soon.
