Justice Questions Delay in Sanam Javed Case During SC Hearing

The Supreme Court on Tuesday heard the Punjab government’s appeal against the acquittal of Pakistan Tehreek-e-Insaf (PTI) activist Sanam Javed in a May 9 riot-related case. The hearing witnessed sharp observations from the bench questioning the delay and legitimacy of the government’s appeal.

Justice Ishtiaq Ibrahim made a striking comment, questioning the motive behind revisiting the case after such a long delay.

“Did you remember after a year that Sanam Javed committed a crime? Tomorrow, will you include my name or someone else’s in the May 9 cases?” he remarked.

The case pertains to a May 9 incident for which Sanam Javed was arrested and later acquitted by the Lahore High Court. The Punjab government, represented by its counsel, challenged this acquittal in the Supreme Court.

Justice Hashim Kakar also questioned the rationale behind the case being reopened:

“The court had instructed that May 9 cases be decided within four months. Why pursue this case now?”

The Punjab government’s lawyer argued that the Lahore High Court had overstepped its authority by acquitting Sanam Javed. In response, Justice Kakar clarified:

“The High Court has the authority. If it receives credible information of injustice, it can act. One cannot turn a blind eye to injustice.”

The government lawyer claimed the High Court does not possess suo motu powers. However, Justice Salahuddin countered, stating:

“In criminal appeals, the High Court also has suo motu powers.”

Justice Hashim Kakar further raised doubts about the legal validity of using the co-accused’s confessional statement as evidence:

“You also know what the legal standing of such a confession is. Let’s leave it at that.”

Following these remarks, the Supreme Court adjourned the hearing indefinitely, casting doubt on the seriousness and timeliness of the appeal.

The Sanam Javed case is one of many stemming from the May 9 incidents, during which nationwide protests erupted following the arrest of PTI founder Imran Khan. Several activists, including women, were detained amid widespread crackdowns.
