The Peshawar High Court has issued a written order restraining the inquiry committee formed by the Speaker of the Khyber Pakhtunkhwa (KP) Assembly from conducting further investigations into the May 9 attack on Radio Pakistan Peshawar.
Justice Sahibzada Asadullah issued the order following a petition challenging the legal authority of the Speaker to establish the commission. According to the petitioner, the notification forming the committee lacks legal status and was not issued under any recognized law.
The petitioner’s lawyer argued that the Speaker has no authority to interfere with ongoing judicial proceedings. The Radio Pakistan case has been pending in the Anti-Terrorism Court for two years, and no external forum is allowed to influence the judicial process. Members of the Provincial Assembly are also implicated in the case, raising concerns over conflict of interest, as “members cannot become judges in their own case,” the petition stated.
In light of these legal concerns, the court has restrained the KP Assembly Speaker’s inquiry committee from proceeding further, reinforcing the principle that ongoing judicial matters must remain free from external interference.
This decision underscores the judiciary’s role in maintaining the independence and integrity of legal proceedings, particularly in high-profile cases involving public institutions and elected officials.
