Supreme Court Declares Pension a Constitutional Right, Rejects Federal Service Tribunal’s Decision

The Supreme Court of Pakistan has delivered a landmark ruling affirming that pension is not a concession but a constitutional right.

The decision came while hearing a petition challenging the Federal Service Tribunal’s rejection of a pension application. The petitioner had resigned from government service in September 2007, after completing 20 years of qualifying service.

The department had previously rejected the pension request on the grounds that the petitioner had not completed 50 years of service. However, the court clarified that under existing law, pension eligibility is granted after 20 years of service, and the right to pension does not expire if requested late.

Justice Shafi Siddiqui, in the six-page verdict, declared the Federal Service Tribunal’s decision null and void, noting that the department’s interpretation under Regulation 418, which relates only to the calculation of service, was legally unacceptable.

The ruling reinforces the principle that government employees’ pensions are a protected constitutional entitlement, and cannot be arbitrarily denied by administrative authorities.
